Homeland Security Rolls Back Extension of Temporary Protected Status for Haitians

Workforce

On February 20, 2025, Secretary of Homeland Security Kristi Noem partially vacated the July 1, 2024, notice that extended and redesignated Haiti for Temporary Protected Status (TPS). The announcement amends the period of extension and redesignation of Haiti for TPS from 18 months to 12 months, with a new end date of August 3, 2025, and makes a corresponding change to the initial registration period for new applicants under the redesignation, which will now remain in effect through Aug. 3, 2025.

The Secretary of Homeland Security may designate a foreign country for TPS due to conditions in the country that temporarily prevent the country's nationals from returning safely or, in certain circumstances, where the country is unable to handle the return of its nationals adequately. United States Citizenship and Immigration Services (USCIS) may grant TPS to eligible nationals of certain countries (or parts of countries) who are already in the United States. Eligible individuals without nationality who last resided in the designated country may also be granted TPS.

It is important to note that employers must re-verify employment eligibility, not just of TPS beneficiaries but other employees as well, before the expiration of temporary work authorization. For information on how to update Form I-9 where the TPS is extended, refer here. More specific details regarding TPS for Hait are available on the USCIS website.
